Terms and Conditions

These Terms and Conditions (the “Terms”) are an agreement between you and CMC Media, doing business as BDC Mastery (“BDC Mastery,” “we,” “us”). They apply to bdcmastery.com (the “Site”) and to our training course and related services (the “Services”). By creating an account or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Who may use the Services

You must be at least 18 years old and be using the Services for business purposes. If you use the Services on behalf of a company, you confirm that you have authority to accept these Terms for it.

2. Your account

Accounts are created by invitation or by signing up. You agree to give accurate information, to keep your password confidential, and to use your account only for yourself. Do not share your login with anyone. Tell us promptly if you think your account has been used without permission. We may suspend or close an account that breaks these Terms.

3. Access and license

Your access lasts for the period stated in your invitation or purchase, or for the lifetime of the course if that is what you bought. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use the course materials for your own internal business training. The materials are licensed, not sold.

You may not copy, record, resell, share or distribute the course materials, or use them to build a competing product, without our written permission.

4. Fees and refunds

Fees, if any, and any refund terms are stated when you purchase or in your written agreement with us.

5. Ownership

We and our licensors own the course materials, the Site and the BDC Mastery name and logos. These Terms do not transfer any ownership to you.

6. Your content

You own what you enter into the Services, such as workbook answers and call-activity entries. You give us a license to host, store and display it to operate the Services for you, to show it to our administrators and your company’s account administrators where applicable, and, in combined form that does not identify you, to improve the Services.

7. Acceptable use

You agree not to break the law using the Services; to interfere with or try to break the security of the Site; to access another person’s account or data; to copy data from the Site with automated tools; or to upload anything unlawful, harmful or that you do not have the right to share.

8. Results are not guaranteed

The course teaches methods for outbound customer calling in auto repair shops. Examples, figures and benchmarks on the Site and in the course are illustrative and are not a promise or guarantee of any result. Your results depend on your shop, your team, your market and your effort.

9. Third-party services

The Services may link to or rely on services run by others. We are not responsible for them, and your use of them is under their own terms.

10. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent the law allows, BDC Mastery and its owners and personnel will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months before the claim arose. Some places do not allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to defend and hold us harmless from claims and costs arising from your breach of these Terms or your misuse of the Services.

13. Ending your access

You may stop using the Services at any time. We may suspend or end your access if you break these Terms. Sections that by their nature should continue after access ends (such as ownership, disclaimers and limits of liability) will continue.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and we agree that disputes will be brought in the state or federal courts located in that state, unless the law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date and, for significant changes, tell you by email or on the Site. Continuing to use the Services after a change means you accept it.
